Terms of Service

1. Definitions and Interpretation

The Company: JCC Customs and Commercials Ltd, Frost Industrial Estate, NR8 6AP, 14668673.

The Customer: The person, firm, or company contracting with the Company for Services.

The Vehicle: The van, motorhome, or other vehicle specified by the Customer.

Services: The respraying, body repair, servicing, or any other work undertaken by the Company as detailed in the Estimate.

Estimate: The initial written or electronic quotation provided by the Company to the Customer detailing the likely cost and scope of the Services.

2. Quotations and Contract

2.1 Quotation Validity

Estimates are valid for 30 days from the date of issue and are based on the Company's initial visual assessment.

2.2 Formation of Contract

A legally binding contract is formed when the Customer accepts the Estimate, either verbally or in writing, and the Company confirms a booking date or commences work.

2.3 Amendments and Additional Work

If, during the provision of Services, additional work or parts are required due to unforeseen damage, corrosion, or complications (e.g., hidden rust found after paint removal), the Company will seek the Customer's prior written or verbal approval before proceeding with the extra work and costs.

2.4 Price

The Customer agrees to pay the final invoice price, which may differ from the Estimate if additional work/parts were approved under Clause 2.3.

3. Payment and Collection

3.1 Payment Terms

Unless otherwise agreed in writing, payment in full for the Services is due immediately upon completion of the work and prior to the collection of the Vehicle.

3.2 Payment Methods

The Company accepts credit/debit card, bank transfer, cash.

3.3 Uncollected Vehicles

The Customer must collect the Vehicle within 5 days of being notified that the Services are complete.

3.4 Storage Charges

The Company reserves the right to charge a daily storage fee of £25 (plus VAT) for any Vehicle uncollected after the 5 day period, unless alternative arrangements have been agreed in writing.

3.5 Lien

The Company shall have a general lien on the Vehicle and its contents for all sums due from the Customer to the Company. Possession will not be passed back to the Customer until full payment has been received in cleared funds.

4. Vehicle Condition, Property, and Liability

4.1 Customer's Personal Property

The Company is not responsible for any loss or damage to personal belongings left inside the Vehicle. The Customer is responsible for removing all valuables and personal items before handing over the Vehicle.

4.2 Fuel and Utilities

The Customer must ensure the Vehicle has a minimum level of fuel/power (e.g., adequate for moving the Vehicle on and off the premises).

4.3 Existing Faults

The Company is only liable for damage caused by its negligence. The Company accepts no liability for existing mechanical, electrical, or structural faults, including pre-existing rust, corrosion, or body filler, which may become apparent during or after the repair process.

4.4 Water Ingress/Damp

The Company accepts no responsibility for pre-existing or resultant water ingress, damp, or related damage, especially in motorhomes or caravans, unless directly and solely caused by the Company's proven negligence in sealing a repaired area.

5. Guarantees and Warranties (Workmanship)

5.1 Workmanship Guarantee

The Company guarantees its bodywork and respraying workmanship for a period of 6 months from the date of collection, against faulty workmanship or incorrect application of repair products.

5.2 Exclusions

The guarantee does not cover:

  • Normal wear and tear, stone chips, or subsequent accidental damage.
  • Defects arising from pre-existing rust/corrosion that reappears beneath the new paint/repair (especially where the Customer declined recommended remedial work).
  • Damage caused by incorrect aftercare, cleaning chemicals, or high-pressure washing.
  • Parts or materials supplied by the Customer.

5.3 Statutory Rights

This guarantee is in addition to, and does not affect, the Customer's statutory rights under the Consumer Rights Act 2015. Services will be carried out with reasonable care and skill and within a reasonable time.

6. Cancellation

6.1 Cancellation by Customer

If the Customer cancels the Services after the contract has been formed, the Company reserves the right to charge a cancellation fee of 20% of the agreed quotation or, if special parts have been ordered, the full cost of the non-refundable parts and any labour already completed.

6.2 Rescheduling

If the Customer wishes to reschedule an appointment, they must provide a minimum of 48 hours' notice. Failure to do so may result in a fee.
